Μα ο Πρόεδρος της Πανηλειακής το είπε ξεκάθαρα: ...Thereafter, following a discussion of the matter, which included that of the contents within the Kapellaki Memorandum, the Board decided that it would not take any action on the issue of the Hleiako Xorio.
As such, the Pan-Elian Federation of USA and Canada will not be taking any action in regards to the Hleiako Xorio (e-mail Dec 29, 2015).

February
15, 2016
Attn:
Honorable Dimitris Kostopoulos, General Secretary and
Honorable
Anthony Papadopoulos, President
Pan-Elian Federation of U.S.A. And Canada
Pan-Elian Federation of U.S.A. And Canada
Gentlemen:
As to your personal letter dated February 08, 2016 (which I am still not in receipt of or noticed by the US postal service) under the color of title (non BD sanctioned) and questionable letterhead I have the following to respond to as a courtesy and only:
1. At no time was I a Supreme President of the organization. Both the incorporation and the bylaws specify simple President, General Secretary etc., This use of SUPREME is a hyperbole, intentionally misleading and insulting to the democratic principles that our ancestors instilled in us and therefore many see as an abuse since it is not the sanctioned designations of the organization.
2. Under the letterhead, I also note multiple representatives. My understanding is that the BD of directors consists of the elected by the general assembly and the designated representatives of the paid organization members therefore there should be 11 total BD of director members (kindly review your bylaws). I know it is nice to include persons from areas where there is no society but they are not members of the Board of Directors and you have by packaging them all together created a distortion. Further, Mr. President as former Director of the Youth for so many years you do know and should know that the Boston representative is named George Rigas Kafkas, there exists no Demitris Kafkas Rigas. The letterhead discrepancies are troublesome and indicative of the current state of affairs which includes the potential defects of meetings and decisions that have come to my attention reach the level of a systemic pattern.
3.
Upon
information and belief this correspondence of yours is being sent as
an illusionary response to the certified letter you both have
received from the Paneliakos Society of Boston. This is unacceptable
if this is what you are doing. It is whole deceptive and does not
address any of the legitimate inquiries made by the Paneliakos
Society of Boston which remain unanswered and which in due time will
be addressed in a proper forum.
In my capacity as General Counsel of the Paneliakos Society of New
England I have been instructed to compel you by legal means to
respond to your legal duties and to seek damages for your failures on
a personal level since your acts are under the guise and color of
title. But
that I leave for a letter from me in my legal capacity. Here I will
answer you in my individual capacity.
Both of you have ignored telephonic communications and emails from
me which further merits consideration as to your systematic breach of
your fiduciary duties.
3. On a positive note, The Federation has had numerous committees and I find it an honor that even now you some 22 months into your tenure are asking for information from one that existed or from me personally.
4. Any records information I have are personal and not the federation’s in that at no time did the federation compensate, pay or reimburse for these records.
5. Any federation records on the matter have been passed to your trust with the transition to your administration on or about May 2014.
6. I urge you to review the two suitcases of federation papers left with you at the May 2014 convention and to provide a written table of contents as to the documents therein pertaining to Elian Village and thus my limited time would be more constructively used to supplement if necessary from my personal files which are located in Greece and some here in the States.
7. Before getting into the depths of your requests, I would like to explain a critical component that eludes you. The Federation was reorganized in 1988 for purposes of promoting the project Elian Village. As a result, some 480 persons gave $20 each and filled out an application ($9,600.00 total received for a specific purpose). At no time during my capacity as Person in Charge and Committee chair was the money used even for a coffee, let alone plane tickets, room and board, stationary, certified copies and thus. Therefore, that money through the years that was taken for a specific purpose and not used would remain available at the last moment for purposes of legal advocacy to achieve the goal of the Elian Village project. Recently, I was forwarded an email by Anthony Papadopoulos sent from Tonypapas@aol.com that the matter of the Elian Village after discussion at a BD meeting was ended… as a result of the Kapellakis memorandum…. Matter closed and that the federation would not discuss this matter again. Despite my emails to Mr. Papadopoulos, he did not return my calls or emails as to getting a copy of this memorandum for review or for my urging that he inform the society members since in essence the BD was overturning the decisions of the General assemblies. I can only assume that your recent reopening of this matter of the Elian Village has to do with your wish to further access the appropriateness of your actions.

8.
It is my unequivocal opinion that if this project goal of the
federation is abandoned and since the initial application funds of
$9,600 were not used for the intended purpose that this money be
returned forthwith to the applicants otherwise the keeping of these
funds and use on other matters can and will be construed as
misappropriation
and unfair and deceptive.
9.
During my Presidency of the Federation, all societies were given an
opportunity to acquire from the General Secretary of the Federation
copies of the file pertaining to the Elian Village. In fact, the
then President of the NY society, Mr. Ilias Dimitropoulos made such a
request and did receive a compendium of documents which he used then
as an add on member of this Elian committee and made contacts in
various ministries in Greece. Both
of you originate and are members of the New York society and these
documents were available to you through your society and thus this
recent inquiry some can consider an attempt to deflect from other
legitimate inquiries pertaining to deficiencies involving your
actions or lack thereof in your capacities as officers of the
federation.
10.
All Conventions of the federation have had the Elian Village as a
topic and my participation among others in presentations and reports
on the subject, thus they are common knowledge and you may retrieve
such from the federation archives in your possession.
11.
At the most recent Convention of May 2014, Mr Ilias Dimitropoulos on
the matter of the Elian Village made a report and submitted his whole
updated file to the President of the Convention, Mr Tentopoulos at
the head table. These documents should have come into both of your
possession as elected officials then and as hosts of the Convention.
If you claim they have not that constitutes an additional failure of
your fiduciary duties since you were sworn in forthwith. Making
any request after 22 months to me again is highly suspect. I however
will entertain it for now.
12.
From
the May 2014 Convention until the present time date of February 11,
2016, neither of you gentlemen have ever asked me telephonically,
electronically or in any communication form for copies of any
documents nor have you asked for my assistance or input or opinion
memorandum nor have you updated me on the most recent Kapellakis
memorandum nor the Augerinopoulou visit in late 2014 where you were
advised of TAIPED. I have been intentionally or negligently omitted
for reasons you only know. For the record, I refer you to ETHNIKOS
KYRIKA, periodical of 17-18 August 2013 where in my extensive
interview on behalf of the Paneliakos Federation, I gave a detailed
opinion how we would wind up in Court for the Elian Village and in
essence I am the precursor to Mr. Kapellakis memorandum, a person to
this date I have not had any communication with and don’t know that
you choose to not disclose his memorandum to the Societies for the
last 12 plus months.
13.
In late December of 2015, I became aware of TAIPED formally having
acquired the real property in Thines and that they had proceeded to
place it on public bid. Then after the fact I was informed that a
few weeks earlier a meeting of the BD pf the Federation was called in
Toronto of which 4 members of the BD showed up lacking a quorum a
telephonic attempt was made to vote for disavowal from the Elian
Village project.
14.
The Boston society and a member of your BD, Bill Kafkas protested and
requested certain proof of documents as to call of meeting, quorum,
vote tally etc., be provided. To date, this has not occurred for
reasons more likely than not pertaining to possible violations of the
New York Amended Statute of 2013 as to nonprofits.
WHEREAS,
I am now the recipient of a letter not supported or sanctioned by the
BD of directors with the preposterous demand I make copies and send
registered mail to all Board members or alleged purported Board
members and others. YOU
BOTH NEED TO DO YOUR DUTIES AND NOT SHIFT THEM TO OTHERS.
As indicated from the outset I will reply as a courtesy but will
only send one response to the General Secretary of the Federation who
may copy all. I provided pro bono to the federation for 26 years
voluntarily, and will provide but one copy as a courtesy to the
federation I served. From there on, I charge $1,000 an hour for my
time, thus you may expend your own time to clean up the situation you
have created. I was told a Greek proverb today that is relevant in
this case. A son in Law after twenty six years decided that he must
engage in assisting in mother in law in her in euthanasia and in
expeditiously burying his mother in law and put her to rest. The
next day after he buried her many people called inquiring about the
mother in law caused him to urgently go to the pharmacy to attempt to
get medicine to try to bring her back to life.
Kindest
Regards,
Demetrios
Kafkas
